The Law Amending the Union
of Myanmar
University Education Law, 1973
(The State Peace and Development Council Law No.
4/98)
The 13th Waning Day of Tabaung 1359 M.E.
(25th March, 1998)
The State Peace and Development Council hereby enacts
the following Law
1. This law shall
be called the Law Amending the Union of Myanmar
University Education Law, 1973.
2. In sub-section
(b) of section 2, section 3, section 5 and clause
(2) and clause (9) of sub-section (c) of section
8 of the Union of Myanmar University Education Law,
1973, before the expression "College "the
expression " Degree College"
shall be inserted.
3. Sub-section
(a) and (b) of section 8 of the Union of Myanmar
University Education Law, 1973 shall be substituted
as follows: -
"8. (a) The Government shall
form the University Central Council comprising the
following persons, in order to lay down policy,
to give guidance and to supervise in respect of
university education:

Ministers of relevant Ministries
administering the University,
Degree College, College and Institute |

Persons assigned duty by the
Government. |

Principals of Degree College

(b) In forming the Universities
Central Council, the Government may, if necessary,
determine the Vice-Chairman and the Joint Secretary
from among the members of the Universities Central
Council."
4. Sub-sections
(a) and (b) of section 9 of the Union of Myanmar
University Education Law, 1973 shall be substituted
as follows: -
"9 (a) The Government shall
form the Council of University Academic Bodies in
order to supervise all matters relating to standard
of university education, syllabus, examination and
education,

5. Clause (7)
of sub-section (c) of section 9 of the Union of
Myanmar University Education Law, 1973 shall be
substituted as follows :
"(7) to implement, after
scrutinizing the university education development
measures submitted by the respective University
Academic Bodies."
6. The expression
" University or College and Institute "contained
in section 10 of the Union of Myanmar University
Education Law, 1973 shall be substituted by the
expression " University, Degree, College and
Institute."
7. Section 11
of the Union of Myanmar University Education Law,
1973 shall be substituted as follows -
"11 (a) The Ministry of Education
shall, to enable systematic administration of the
universities under it form the Higher Education
Department (Lower Myanmar) and the Higher Education
Department ( Upper Myanmar).
(b) The other Ministry which administers
the university or universities shall, to enable
systematic administration of the university or universities
under it determine and assign duty to any department
as may be necessary."
8. In section
12 of the Union of Myanmar University Education
Law, 1973:-
(a) the expression "Ministry
of Education or" contained in clause (3) of
sub-section (b) shall be deleted;
(b) clause (7) of sub-section
(b) shall be substituted as follows : -
(7) Head of Department . . .Secretary
(Administration/Finance) or Registrar of Assistant
Registrar".,
(c) sub-section (f) shall be substituted
as follows.
"(f) The relevant Ministry
administering the Degree College, College and Institute
shall form the Management Bodies of Degree College,
College and Institute and determine the duties and
functions thereof."
9. Section 15
of the Union of Myanmar University Education Law,
1973 shall be substituted as follows: -
"15 To carry out the previsions contained in
this Law:
(a) the relevant Ministry administering
the University, Degree, College, College and Institute
may, with the approval of the Government, issue
rules and procedures;
(b) the relevant Ministry administering
University, Degree College, College and Institute
or the Department under such Ministry may issue
such orders and directives as may be necessary."
