The Myanmar Aerospace Engineering University Law

The State Peace and Development Council hereby enacts the following Law: -

Chapter I
Title and Definition

1. This Law shall be called the Myanmar Aerospace Engineering University Law.

2. The following expressions contained in this Law shall have the meanings given hereunder:

(a) University means the Myanmar Aerospace Engineering University established under this Law;

(b) Council means the University, Council formed under this Law to supervise the functions and duties of the Myanmar Aerospace Engineering University;

(c) Rector means the Rector of the Myanmar Aerospace Engineering University.


Chapter II
Establishment

3. The Myanmar Aerospace Engineering University is hereby established from the date on which this Law comes into force.

4. The Ministry of Science and Technology may establish the degree colleges, colleges, institutes and schools affiliated to the University, as may be necessary, with the approval of the Government.


Chapter III
Aims of the University

5. The aims of the University are as follows

(a) to contribute towards modernization and development of the State by Aerospace Engineering;

(b) to nurture the ethical, skillful and reputable Aerospace Engineers;

(c) to teach science and technology contributory to the profession relating to Aerospace Engineering;

(d) to make plans and arrangements for perpetual development of Aerospace Engineering;

(e) to have the knowledge, standards and recommended practices prescribed by the International Civil Aviation Organization;

(f) to carry out the necessary research works for the development of the Aerospace Engineering.

Chapter IV
Formation of the Council

6. The Ministry of Science and. Technology with the approval of the Government: -

(a) shall form the University Council-comprising the following persons:-

(b) if necessary, may determine a vice chairman and a joint secretary assign duty to them.

(c) may alter and form the Council as may be necessary.

Chapter V
Functions and Duties of the Council

7. The functions and duties of the Council are as follows

(a) laying down the educational policies and guidance's of the University;

(b) recommending and submitting to establish the degree colleges, colleges, institutes and schools affiliated to the University;

(c) laying down the work programmes to be carried out in implementing the aims of the University;

(d) co-ordinating and carrying out in respect of determining the degrees, diplomas and certificates to be conferred by the University;

(e) co-ordinating and determining the grade of experience of the Aerospace Engineering determined by the International Civil Aviation Organization to which the degrees, diplomas and certificates to be conferred by the University are equivalent;

(f) carrying out, if necessary, for recognition of the Aerospace Engineering degrees, diplomas and certificates conferred by the foreign countries;

(g) determining the educational qualification of the faculty staff who would be serving at the University;

(h) determining the number of students to be admitted to the University in accordance with the requirement of the State;

(i) laying down the schemes and carrying out for performing the research works to develop Aerospace Engineering and dissemination of such engineering;

(j) deciding in respect of conferring honorary degrees relating to Aerospace Engineering;

(k) supervising and co-ordinating the functions and duties of the University Academic Body and University Administrative Body, and the academic and administrative functions and duties of degree colleges, colleges, institutes and schools affiliated to the University; and determining the submissions thereof;

(l) obtaining necessary technical assistance and other assistance from the Government Departments and Organizations and local and foreign organizations;

(m) forming necessary sub-committees to implement the functions and duties of the Council and determining the functions and duties thereof.

8. The non-governmental members of the Council are entitled to receive the remunerations determined by the Ministry of Science and Technology.

Chapter VI
Formation of the University Academic Body and
University Administrative Body

9. The Council shall, for carrying out the functions and duties of scrutinizing and approving the syllabi, curriculums and books according to the subjects to be taught in University, of conferring degrees, diplomas and certificates; and other academic functions and duties, form the Academic Body with the Rector as Chairman.

10. The Council shall, for carrying out the financial functions of the University, functions and duties relating to maintenance of discipline of the students and other administrative functions, form the University Administrative Body with the Rector as Chairman.

11. The Council shall determine the functions and duties of the University Academic Body and the University Administrative Body.

12. The non-governmental members of the University Academic Body and University Administrative Body are entitled to receive the remunerations determined by the Ministry of Science and Technology.

Chapter VII
Organizational Set-up


13. The Council shall prepare, approve and maintain the necessary organizational set-up based on the academic and administrative functions and duties in the manner prescribed.

14. The Council in appointing the faculty staff and personnel:

(a) have the power to appoint within the organizational set-up in accordance with the existing regulations, bye-laws and directives;

(b) may, in consultation with the relevant departments, transfer, obtain and appoint faculty staff and personnel who are qualified to carry out effectively the academic and administrative functions and duties.

15. The Council may delegate powers relating to affairs of the personnel to the Rector, as may be necessary.

Chapter VIII
Finance

16. The Rector shall submit the annual budget estimate of the University to the Ministry of Science and Technology, obtain approval thereof and carry out accordingly.

17. The Rector shall maintain accounts, and make credits and debits in respect of receipts and expenditures of the University in accordance with the existing financial regulations, bye-laws and directives.

Chapter IX
Miscellaneous

18. The University shall have the power to confer degrees, diplomas, certificates and honorary degrees relating to Aerospace Engineering.

19. The University shall have perpetual succession and a common seal and shall have the power to sue and be sued in its corporate name.

20. The University shall, in order to implement successfully the academic and administrative functions, have the power to communicate with the Ministries, Government Departments and Organizations and other local and foreign organizations, and to obtain the technical and other necessary assistances there from.

21. For the purpose of carrying out the provisions of this law:

(a) the Ministry of Science and Technology may, with the approval of the Government, issue rules and procedures as may be necessary;

(b) the Ministry of Science and Technology and Council may issue orders and directives as may be necessary.
